By accessing or using Hypervize services, you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site and our services.

2. Description of Service

Hypervize provides access to a network of high-performance computing resources, including GPU instances, bare metal servers, and AI inference endpoints. Our services include but are not limited to:

• On-demand and spot compute instances
• Managed inference endpoints
• Model hosting and deployment tools
• API access for AI workloads

3. Accounts and Registration

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Infringe upon the rights of others
• Transmit any material that is defamatory, offensive, or otherwise objectionable
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Use the Service for training models that compete directly with our offerings without written permission
• Reverse engineer or attempt to extract source code

5. Intellectual Property

The Service and its original content, features, and functionality are owned by Hypervize and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You retain ownership of any models, data, or content you upload ("Your Content"). By uploading Your Content, you grant us a license to host, run, and serve it as necessary to provide the Service.

6. Billing and Payment

Certain aspects of the Service may be provided for a fee. You agree to pay all fees associated with your use of paid features. All fees are non-refundable except as required by law or as explicitly stated in our refund policy.

We reserve the right to change our fees at any time. We will provide reasonable notice of any price changes.

7. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact support.

8. Limitation of Liability

In no event shall Hypervize, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

9. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Hypervize expressly disclaims all warranties of any kind, whether express or implied.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of material changes by posting the new Terms on this page.
